We know it’s tempting to skip these Terms of Service, but it’s important to establish what you can expect from us as you use our services, and what we expect from you.

Projection's Terms and Conditions
In this User Agreement (this "Agreement"), "you" means the individual accessing the Site. To the extent applicable, "you" also includes the corporation or other legal entity, if any, on whose behalf you are accessing the Site. In this Agreement, "Projection" means Projection Video Services, Inc., a Virginia corporation d/b/a Projection Presentation Technology.

Your use of the Site is subject to the terms and conditions of this Agreement. In addition, as set forth more fully below, any purchase of goods or services through the Site shall be subject to such additional terms and conditions as may be set forth in any exhibitor kit associated with the event for which such purchase is made.

Equipment Rentals. You agree to all of the following conditions:

You are leasing equipment and accessories (herein collectively referred to as Equipment).
No sale, conditional or otherwise, applies to this transaction.
The equipment selected is described on the price list or in the corresponding exhibitor kit.
You agree that by placing an order through this site you agree to all terms and conditions of this Agreement, you have read this Agreement, understand this Agreement and agree to be bound by the Agreement between you and Projection.

Term. For each transaction processed through this Site, the term of the provision of the Agreement begins on the date of shipment of equipment and shall continue until the equipment is received back to Projection in the condition in which it was accepted.

Acceptance. You acknowledge that upon receipt of the equipment you have fully inspected and accepted said equipment in good working condition.

Payment. The obligation to pay one hundred percent of equipment rentals shall commence on the date the order was placed through the Site. All sales are final unless a written request for cancellation is received by Projection prior to ten days of the start of the event. Upon receipt of request for cancellation received prior to ten days of the start of the event a full refund will be made less a processing fee of one-hundred dollars ($100.00). In the event that a cancellation request is received after date of shipment you agree to pay a cancellation fee of one hundred percent (100%) of the Agreement price.

Should additional charges be incurred on-site that are not covered by your initial order, you hereby authorize Projection to charge your account for such additional goods or services with payment immediately made via credit card. Any past due balances are subject to a service charge of 1-1/2% per month (18% Annual Percentage Rate) with reasonable attorney’s fees also charged, if applicable.

Username and Password. In order to obtain access to the Site, you must have a Username and Password. You are not permitted to share your Username and Password and are responsible for maintaining the confidentiality of your Username and Password. You are responsible for all acts and omissions that occur under your Username or Password whether or not authorized by you. You will immediately notify Projection of any unauthorized use of your Username or Password or any other breach of security relating to the Site or of this Agreement of which you become aware.

Restrictions. By using this web site or any service provided, you explicitly agree that: (a) you will not provide any content or conduct yourself in any way that may be construed as: unlawful; illegal; threatening; harmful; abusive; harassing; stalking; tortuous; defamatory; libelous; vulgar; obscene; offensive; objectionable; pornographic; designed to interfere with or disrupt the operation of this web site or any service provided; infected with a virus or other destructive or deleterious programming routine; giving rise to civil or criminal liability; or in violation of an applicable local, national or international law; (b) you will not impersonate or misrepresent your association with any person or entity; you will not forge or otherwise seek to conceal or misrepresent the origin of any content provided by you; (c) you will not collect or harvest any information about other users; (d) you will not provide any content that may give rise to Projection being held civilly or criminally liable, or that may be considered a violation of any local, national or international law.

Loss and/or Damage. You hereby assign and shall bear the entire responsibility and liability for the actual cost to repair or replace any equipment which during the period between delivery to you and return to Projection has been lost, stolen or damaged. You shall indemnify and hold Projection harmless from any and all claims, liabilities, losses, costs and expenses arising from the use, possession, operation or renting of the equipment. Acceptance by Projection of the return of any equipment shall not be deemed a waiver by Projection of any claims which Projection may have against you under this paragraph, including any damages for which you are liable hereunder which is discovered later.

Insurance. Upon request by Projection, you agree to provide a certificate of insurance naming Projection as an additional insured and Loss Payee. The amount of such coverage shall not be less than the amount necessary to cover the replacement cost of any and all equipment rented, and shall include liability coverage of not less than $1,000,000.

Privacy Policy. Your right to privacy is important. Projection believes that the personal information you choose to furnish online should only be used to provide you with the highest quality products, services and support. Projection will not share your personal or credit card information with any other third-parties.

Disclaimer of Warranties. You acknowledge and agree that Projection makes no warranty, express or implied, regarding equipment, including without limitation any warranty of merchantability or fitness for any purpose. Projection's obligation to you shall be limited to the repair or replacement of equipment which is defective when delivered to you and you agree that this shall be its sole and exclusive remedy.

Limitation of Liability.Your use of this Site is at your sole risk and in no event shall Projection or any third party provider or distributor be liable for any direct, indirect incidental, punitive or exemplary damages, including but not limited to damages for loss of profits, loss of data, privacy, security which arise out of or are in any way connected with this Agreement and use of this Site.

The limitations of liability in this Agreement shall apply to the fullest extent permitted by applicable law even Projection or any third party provider or distributor should have known of the possibility of such damages without regard to such remedies.

Notwithstanding any of the foregoing limitations Projection or any third party provider or distributor found liable for any injury, loss, claim or damage which arises out of this Agreement, the total liability of Projection or its third party provider or distributor shall in no event exceed, in the aggregate, $250.00.

Miscellaneous. This Agreement shall be governed by the internal laws of the State of Virginia, and the rights and obligations of the parties hereunder shall be determined according to such laws. You submit to venue and jurisdiction over any dispute related to this Agreement and this Agreement shall constitute the entire Agreement between Projection and you with respect to the rental of equipment. The person signing this Agreement warrants that such individual has been duly authorized to execute this Agreement binding you to Projection's terms and conditions for this and all future transactions.

This Privacy Policy (the “Policy”) governs the manner in which Projection collects, uses, maintains, and discloses information collected from you in connection with the Projection online storefront.

Projection may collect and store information about you and/or your business including your or your business’s name, email address, phone number, mailing address, accounting transaction data, payment or other financial information, aggregate transaction data, customer sales and order information, third-party data, business data, browser data, devices used, technical information about your means of connection to applications, and any other information or data submitted by you or third parties in connection with our Software Services, Storefronts, or other services rendered pursuant to the Agreement (the “Information”).

Information Use

Information collected may be used in connection with or for purposes of providing services to you, your business, and to others, improving services provided to you, your business, or to others, providing notices to you, complying with applicable law, and any other lawful purpose, including protecting the health or safety of you or others, and monitoring and preventing fraudulent or unlawful third-party activity.

Commercial Use of Information

Projection will not sell or share the Information with third parties for any commercial purposes without your consent and express agreement. Projection may, however, use the Information in order to share generic, collective, group, or other non-identifying information about the use of Projection’s products and services as part of commercial transactions with third parties to help Projection improve its products and services or for any other lawful purpose.

Third-Party Service Providers

Projection may use third-party service providers and vendors to assist Projection in providing its products and services to you and others, including, without limitation, services to host Projection’s Software Services, Storefronts, payment processes, and other services pursuant to the Agreement. Projection may also use third-party service providers and vendors to store Information and other data. Any such third parties would have access to your Information for the limited purpose of assisting, as reasonably necessary, Projection in providing Software Services and other services pursuant to the Agreement.

Projection may disclose your Information as Projection reasonably believes is required by court order, governmental directive, or other law, to protect the rights of Projection, or as otherwise allowed pursuant to the Agreement or applicable law.

Information Protection

Projection will retain, protect, and process the Information and underlying or related data using commercially reasonable practices. Although Projection will undertake such efforts to preserve and protect the integrity of the Information, you acknowledge and agree that all security measures have potential risks.

Customer Control of Collected Data

You may decline to provide or submit Information to us, however, some of our Software Services, Storefronts, or other services may not be available to you if you choose not to provide or submit Information. You also have a right to access the Information that we hold (about you) upon reasonable written request.

Updates to our Policy

By entering into the Agreement or the Acknowledgment or by using our products or services, you consent to the collection and use of your Information by us consistent with this Policy and the Agreement. We may change this Policy from time to time, for any reason. Any such changes become effective when posted.

To the extent that this Policy is inconsistent with applicable law, it is the intent of Projection to comply with applicable law. If there is any conflict between any provision of this Policy and applicable law, such applicable law shall prevail; provided, however, that any such conflicting provision in this Policy shall be curtailed and limited only to the extent necessary to bring it within the legal requirements and the remainder of this Policy shall not be affected thereby.

Does this site use cookies?

Yes, Boomer Commerce uses cookies. A popup will periodically ask you to confirm that Boomer Commerce is allowed to install cookies locally on your browsers to run the application correctly. If you deny Boomer Commerce to do so, you will not be able to access most of the Boomer Commerce site as these cookies provide essential functional purposes for it to work correctly.

Without this information, we may not know who you are or if you are allowed to access information on the site and will mostly deny access in order to preserve data security. Can I opt out of cookies on this site?

Yes, you will be prompted to allow Boomer Commerce to use cookies upon accessing the site for the first time on a given device or browser or when an extended amount of time has passed since the last time you accessed the site.
